Terms of Service for CineVibe

1. Acceptance of Terms

By downloading, installing, accessing, or using the CineVibe mobile application (the “Application”) or its accompanying website, you agree to be bound by these Terms of Service (the “Terms”). If you do not agree to these Terms, do not install, access, or use the Application.

2. Description of the Service

CineVibe is a personal media-tracking and cataloging tool provided as a free service. The Application allows users to explore entertainment metadata, manage personal watchlists, track television episode progress, curate custom collections, and optionally synchronize data across personal devices. The Application is licensed for personal, non-commercial use only.

No Video Streaming or Content Hosting

CineVibe does not stream, host, broadcast, archive, or distribute full-length movies, television episodes, or copyrighted media files. The Application functions strictly as an informational tracker, organization catalog, and personal log. Video trailers available within the Application are embedded and served directly by YouTube via their official API services.

3. User Accounts and Data

• Local-First Usage: You may use the Application locally on your device without registering an account. Local data remains stored on your device.
• Cloud Synchronization: If you opt to sign in using Google Sign-In, authentication and cloud data synchronization are handled via Google Firebase. You are solely responsible for maintaining control and security over the Google account credentials used to access the service.
• Account Deletion: You may permanently delete your cloud account and all associated cloud data at any time via the in-app settings (Profile / Account → Settings → Delete Account) or by sending a verified deletion request via email.

4. Third-Party Services and Content

CineVibe relies on external third-party services and Application Programming Interfaces (APIs) to provide media information, imagery, streaming availability, and trailers. Your use of the Application is subject to their respective terms and operating policies:

The Movie Database (TMDB)

• CineVibe utilizes the TMDB API to fetch movie and television metadata, cast lists, crew credits, and artwork.
• Attribution: This product uses the TMDB API but is not endorsed or certified by TMDB.
• CineVibe claims no ownership over third-party media metadata, plot summaries, or poster imagery provided via TMDB.

JustWatch

• Streaming availability and provider data displayed within the Application are powered by JustWatch.
• CineVibe does not control or guarantee the real-time accuracy of subscription, rental, or purchase pricing and availability provided by JustWatch.

YouTube API Services

• Video trailers in the Application are delivered via YouTube API Services.
• By accessing or viewing trailers within the Application, you agree to be bound by the YouTube Terms of Service and acknowledge the Google Privacy Policy.

Streaming Availability & External Links

• The Application may display regional streaming provider availability or link to external third-party websites and platforms.
• Streaming rights, pricing, and regional availability fluctuate frequently without notice. CineVibe does not monitor, control, endorse, or assume responsibility for the accuracy of streaming availability, third-party content, or external platform practices.

5. User Content

You retain ownership of any text notes, custom list titles, and descriptions you create within the Application (“User Content”).

By enabling cloud synchronization, you grant CineVibe and its hosting infrastructure a limited, worldwide, non-exclusive license solely to transmit, store, format, and display your User Content across your authenticated devices to operate the service. You agree not to store User Content that is defamatory, harassing, unlawful, or infringes on third-party intellectual property rights.

6. Prohibited Conduct

You agree not to engage in any of the following activities:

• Reverse engineering, decompiling, disassembling, or attempting to discover the source code of the Application, except where expressly permitted by applicable law.
• Disrupting, overburdening, compromising, or interfering with the servers, networks, or API infrastructure powering the Application.
• Using automated tools, scrapers, crawlers, or bots to harvest data, simulate user interactions, or bypass system constraints.
• Using the Application for any unlawful, fraudulent, or unauthorized purpose.

7. Intellectual Property Rights

All software code, graphic designs, interfaces, app branding, visual layouts, and original assets associated with CineVibe belong exclusively to the developer. All media titles, logos, poster art, trademarks, and copyright assets referenced within the Application belong to their respective studio and intellectual property owners.

8. Service Modification and Termination

We reserve the right to modify, suspend, update, or discontinue any feature, API integration, or cloud synchronization service at any time, with or without notice. We may terminate or restrict access to cloud sync services for users who violate these Terms or abuse system resources. You may discontinue use of the Application at any time by uninstalling the app and purging your account data.

9. Disclaimer of Warranties

The Application is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We make no representations or warranties that:

• The Application will operate uninterrupted, secure, or free from software bugs or errors.
• Metadata, air dates, release schedules, or streaming provider listings supplied by external APIs will be complete, accurate, or timely.
• Stored or synced data will be immune to loss, device corruption, or unauthorized interception. You are encouraged to maintain independent backups of critical data.

10. Limitation of Liability

To the maximum extent permitted by applicable law, the developer shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages-including loss of data, device failure, lost time, or loss of goodwill-arising from or in connection with your access to, use of, or inability to use the Application or third-party services integrated within it.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

12. Changes to These Terms

We reserve the right to revise or replace these Terms periodically to accommodate legal obligations, security standards, or feature updates. Revisions become effective immediately upon publication on this page. Your continued use of the Application following any updates constitutes acceptance of the amended Terms.
